1. Acceptance of Terms
Welcome to Find House (the “Platform”). By registering an account, browsing the website, using the Platform’s services, listing a property, making an enquiry, submitting information, using any AI feature or using the Platform in any manner whatsoever, any person, including but not limited to a visitor, member, owner, buyer, tenant, real estate agent, real estate company or other third party, acknowledges that such person has read, understood and agreed to be bound by these Terms & Conditions. If the user does not agree to any provision hereof, the user must immediately cease using the Platform. These Terms constitute a legally binding agreement between the user and Find House.
2. Nature of Platform and Status
Find House is a technology platform. The Platform primarily provides property information display, property search, property matching, customer enquiry referral, AI analysis tools, AI search tools, AI customer service tools, AI recommendation tools, data analytics services and other technical services. Find House is not a real estate agent, broker, intermediary, developer, property owner, buyer’s agent, leasing agent, mortgage intermediary, investment adviser, financial adviser or legal adviser. Find House does not participate in any sale, purchase, leasing, mortgage, assignment or other transaction arrangement. All transactions are determined solely by the relevant parties at their own risk.
3. Account Responsibility
The user represents and warrants that all information submitted by the user is true, accurate, complete and up to date. The user shall be solely responsible for safeguarding the user’s account, password and login credentials. Any act carried out through the account shall be deemed to have been performed by the user. If the user becomes aware of any unauthorised use of the account, the user shall immediately notify Find House. Find House shall not be liable for any loss arising from theft, loss or third-party use of the account.
4. Platform Rights
Find House reserves absolute and final discretion. Find House may, at any time and without prior notice or giving any reason, reject any registration, reject any listing application, modify any content, hide any content, delist any property, restrict exposure, restrict functions, suspend accounts, terminate accounts, restrict use by territory, modify the membership system, modify the pricing model, introduce paid features, convert free services into paid services, amend package contents or discontinue any service.
5. Property Data and Content Disclaimer
All property information, images, videos, descriptions, prices, areas, transaction data, agent information and related content are provided by third parties. Find House does not warrant truth, accuracy, completeness, legality, timeliness, marketability, lettability or salability. Find House has no obligation to pre-screen, verify, investigate, monitor or validate any property information, agent information, user information, image, video, comment, message, rating or AI content. The user shall independently verify all information.
6. The Platform Is Not a Recommender
The user acknowledges and agrees that any search results, AI recommendations, ranking results, featured listings, hot listings, agent ranking, lead ranking, scoring results or exposure ranking may be generated by algorithms, commercial rules, paid promotion, advertising arrangements or technical factors. Such content does not constitute any platform recommendation, endorsement, approval, warranty, investment advice, transaction guarantee or property quality guarantee. The user shall make independent judgment.
7. No Guarantee of Commercial Outcomes
Without limiting the foregoing, Find House does not guarantee any customer enquiries, property viewing arrangements, number of customers, number of transactions, leasing speed, sales speed, investment return, revenue growth, advertising effect, lead quality, AI effect, SEO effect or market exposure effect, or any commercial outcome whatsoever.
8. User-Generated Content
The user shall be solely responsible for all content uploaded, published or submitted by the user, including comments, messages, ratings, images, videos, agent profiles, company introductions, property content and promotional content. Find House accepts no responsibility for any user content.
9. Licence and AI Training Authorisation
The user agrees that upon submitting, uploading, publishing or providing any content to the Platform, the user grants Find House a perpetual, irrevocable, worldwide, royalty-free, sublicensable right to use such content, including property data, images, videos, titles, descriptions, messages, comments, transaction data and usage data, for platform display, search, promotion, advertising, market analysis, AI training, AI recommendation, machine learning, data analytics and statistical purposes. Such licence shall remain in full force notwithstanding the user ceasing to use the Platform, delisting of any property or termination of the account.
10. Prohibited Conduct
The user shall not publish false information, impersonate any person, disseminate unlawful content, infringe intellectual property rights, interfere with platform operations, attack systems, disseminate viruses, collect data without authorisation, use bots or automated tools, or manipulate rankings or recommendation results. Find House may immediately terminate the account.
11. Scraping and System Protection
Without Find House’s prior written consent, no person may engage in scraping, crawling, data mining, data extraction, reverse engineering, copying of databases, bot collection or automated data collection. Any breach may result in legal action.
12. Intellectual Property
All systems, software, source code, AI models, trademarks, logos, designs, databases, interfaces and platform content are owned by Find House or its relevant licensors. No unauthorised use is permitted.
13. Service Interruption
Find House may suspend or terminate any service due to maintenance, upgrades, system updates, technical issues or security issues. Find House shall not be liable therefor.
14. Force Majeure
Find House shall not be liable for any service interruption caused by network failures, power failures, AWS failures, OpenAI failures, Google failures, failures of third-party services, natural disasters, fire, epidemic, pandemic, war, terrorist acts, government policies or changes in law.
15. Fees and Refunds
Subject to applicable law, all fees paid are non-refundable, including subscription fees, membership fees, promotion fees, advertising fees, exposure fees and AI service fees.
16. Limitation of Liability
To the maximum extent permitted by law, Find House shall not be liable for any direct, indirect, incidental, special or consequential loss, including loss of profit, failed transaction, business loss, data loss, loss of goodwill, investment loss, revenue loss or customer loss.
17. Liability Cap
In any event, Find House’s total liability to any user shall not exceed the total fees paid to Find House in the preceding twelve months. If no fee has ever been paid, the maximum liability shall be HK$100.
18. Indemnity
The user shall fully indemnify Find House against all losses, liabilities, costs and legal fees arising out of or in connection with any act, breach, infringement, false information, unlawful content, third-party claim, regulatory investigation or legal proceeding arising from the user’s conduct.
19. Dispute Resolution and Arbitration
Any dispute shall first be resolved through good-faith negotiation. Failing resolution, the parties agree to refer the dispute to arbitration administered by the Hong Kong International Arbitration Centre (HKIAC) in accordance with its arbitration rules then in force, and the arbitral award shall be final and binding.
20. Waiver of Class Actions
The user agrees to bring claims against Find House only in an individual capacity and shall not participate in or initiate any class action, representative action or class arbitration.
21. Amendments
Find House may amend these Terms at any time. The amended version shall take effect immediately upon publication on the Platform. Continued use of the Platform after any amendment shall constitute acceptance of the amendment.
